Millions of dollars have been collected on behalf of innocent victims!

Angie Beauchamp, Shelly Fraley and Doyle Barker, surviving and beloved daughters and husband of Suzy Barker have filed today a Civil lawsuit against Toyota Motor Company and Loving Toyota for the wrongful death of beloved Suzy Barker.

Suzy Barker a Certified Respiratory Therapist at Nacogdoches Memorial Hospital, purchased her 2009 Toyota Matrix S Edition from Loving Toyota.  She was unaware of the vehicle’s hidden and potentially lethal defects, of which Toyota was or should have been aware.

On April 2, 2010, at approximately 2:46pm, Suzy Barker was the belted driver of the subject vehicle.   She was driving at a safe rate of speed, proceeding westbound on two lane State Highway 21 in the area near Nacogdoches, Texas, within Nacogdoches County.  As she was driving, the vehicle suddenly accelerated at a high rate of speed and she was unable to stop the vehicle by braking.  Her vehicle went out of control and hit an oncoming eastbound Truck with a Pull Trailer head on.

As a result of the collision, Mrs. Barker died of her injuries at the hospital.

As a result of Toyota’s conscious disregard for the safety of consumers, numerous individuals have been killed or severely injured.

As a result of Toyota’s marketing campaign and the guise of safety created by Toyota, numerous consumers purchase and drove Toyota vehicles, including Plaintiff.

Millions of Toyota vehicles were not equipped with a safety feature, known as “brake-to-idle” override, that enables drivers to override the electronic throttle and control the vehicle in the event of a sudden unintended acceleration”, stated Enrique Serna of Serna & Associates, PLLC, attorneys for the representatives of the Estate of Suzy Barker.  The safety feature is used by other automotive manufacturers.  Toyota’s failure to incorporate it played a direct role in the death of Suzy Barker.
